INTRODUCTION: These terms of use constitute a legally binding agreement between you, whether individually or on behalf of an entity ("you"), and Pakty Tunisia ("Company", "we", or "our"), regarding your access and use of the website pakty.shop as well as any other form of media, media channel, site, mobile application, or otherwise connected thereto (collectively, the "Site"). We are registered in Tunisia and have our registered office at Menzah 4 (1004), Immeuble Saadi, Tunisia. You acknowledge that by accessing the site, you have read, understood and agreed to be bound by all of these terms of use. Please read the following terms of use ("Terms") carefully before accessing or using any of our services. Each time you access or use the Service, you agree to be bound by these Terms. If you do not agree to be bound by all of these Terms, you may not access or use the Service. GENERAL PROVISIONS: Access and use of the website, as well as the products and services, are subject to these T&Cs. By using the services, the user accepts the T&Cs, which may be updated regularly. Access to the website is authorized on a temporary basis. The company reserves the right to withdraw or modify the services without notice. The company will not be held responsible if the site becomes inaccessible at any time or for a given period. The company reserves the right to restrict access to certain parts or the entire website. This general preamble establishes the legal framework for the use of the website and the services offered. It clarifies the rights and responsibilities of the company towards the users. This introductory section is essential to define the basic rules governing access and use of the e-commerce site. PRIVACY RULES: Pakty is committed to protecting the privacy of website visitors and customers. The company does not disclose customer information to third parties except when necessary to provide a service (such as product shipping, banking/security checks, customer studies) or with the customer's explicit consent. The company pledges not to share customers' personal information (names, addresses, emails, banking details, etc.) with third parties without prior consent from the customer, except with its own partners. It reassures customers that their information will be protected and used solely within the context of the business relationship, unless expressly authorized otherwise. In all data processing procedures (entry, recording, and use), we strictly adhere to the legal requirements in force regarding data protection. ARTICLE 1. SCOPE OF APPLICATION: These General Terms and Conditions of Sale (GTCS) apply to all orders received by the website pakty.shop. The GTCS become effective on the date the order is placed by the customer. ARTICLE 2. PROHIBITIONS: By using the Site and Services, the User Client is prohibited from: Using, selling, or reselling the Deliverables and Services for professional purposes; Distributing viruses or other technologies that may harm the Deliverables and, more generally, any action that may damage the integrity of the Deliverables, damage them, or expose Pakty Tunisia’s liability to other users or third parties; Using the Deliverables and Services for purposes and/or under conditions contrary to the regulations in force and these General Terms and Conditions of Sale and Use; Making abnormal or abusive use of the Site that could damage it or compromise its access or use by Pakty Tunisia and other User Clients, and specifically not to modify, circumvent, disable, alter the Site or disassemble, decompile, perform reverse engineering or seek the source codes of the Site; Impersonating a third party; Having their computer system contain viruses, files, or codes likely to interrupt, limit, or undermine the proper functioning or security of the Site; Undermining the Sites of Pakty Tunisia. Any violation of the aforementioned prohibitions constitutes a serious breach by the User Client of their obligations. Pakty Tunisia reserves the right, without prejudice to any other legal action, to suspend or permanently delete the account of the concerned User Client, as well as to suspend or terminate any ongoing order. ARTICLE 3 – TECHNICAL PREREQUISITES: Before using the Services, the Client User must ensure that they have the necessary technical prerequisites, which are at a minimum: High-Speed Internet Access A computer, a digital tablet, or a phone. The Client User is responsible for verifying the compatibility of their equipment and maintaining its proper functioning. Pakty Tunisia disclaims all responsibility for technical problems related to the Client's equipment, and no cancellation or termination of orders will be accepted for compatibility reasons. ARTICLE 4 – CONDITIONS OF USE OF SERVICES: To access the Services, the Client User must first create an account on the website www.pakty.shop according to the modalities indicated on the Site. By creating their account, the Client User guarantees Pakty Tunisia that they are capable of entering into a contract and are not a professional acting for the needs of their business. The Client User guarantees that the data provided during the creation of their account and throughout the use of the Site are accurate and true. The Client User agrees not to use a pseudonym or alias, or to impersonate a third party. Any registration of a minor or incapacitated Client User must be done with the authorization and under the responsibility of their legal representative. The login credentials are personal and confidential. The Client User is solely responsible for their use and safekeeping and agrees not to disclose them to third parties, even for a limited period. The Client User can change their Access Codes on their personal account. Any connection is presumed to be made by the Client User themselves. In case of theft, loss, and/or unauthorized use of their login credentials, the Client User must inform Pakty Tunisia as soon as possible, whose contact details are at the beginning of these terms. Pakty Tunisia may then suspend access to the Client User's personal account. New login credentials will be issued by Pakty Tunisia to the Client User. You acknowledge and agree that you are solely responsible for your decisions made on or through the use of the website. Our services provide a platform through which you can obtain information and find third-party service providers, including, but not limited to, interior designers ("service providers"). You acknowledge and agree that you rely on your own judgment to select the products or services offered by the service providers. ARTICLE 5 - Use of Our Content: We grant you a limited license to access, print, download, or make personal use of the Content and the Collective Work, provided that you do not remove any proprietary notices. You may not modify the Content or the Collective Work, use them for commercial purposes, publicly display them, sell them, rent them, decompile them, disassemble them, or transfer them to another person or entity. Unless otherwise authorized by copyright laws, no copying, distribution, transmission, publication, or commercial use of the Content and the Collective Work is permitted without our prior written permission. Article 6 - Electronic Communications: When you visit our Services or send us an email, you are communicating with us electronically. You consent to receive communications from us electronically. While we may choose to communicate with you by regular mail, we may also opt to communicate with you via email or by posting notices on our Services. You agree that all agreements, notices, disclosures, and other communications provided to you electronically meet any legal requirement that such communications be in writing. Therefore, Pakty Tunisia will take legal action, including in cases of infringement, against anyone who violates its rights, directly or indirectly. Furthermore, Pakty Tunisia informs you that the website www.pakty.shop is a protected work and that it holds the copyright to each of its pages, its structure, and each element therein (inspirations, texts, etc.). Any use or reproduction of any element of the site is strictly prohibited. Although Pakty Tunisia has taken all necessary precautions to ensure the reliability of the information and the security of access to its website www.pakty.shop, the company cannot guarantee the complete absence of material errors, technical failures, or other unforeseen issues. Likewise, Pakty Tunisia cannot provide any guarantee regarding the perfect suitability of the site for all users' specific needs and uses. Therefore, Pakty Tunisia disclaims all liability for any damage that may result from the use of its website and is not responsible for the content of other websites to which it may be linked through hyperlinks or other means. Article 8 - TERMS OF SALE: 8.1 - Description of Services: The deliverable generally includes a 360° panoramic view, multiple 3D visuals, a list of product references, and services associated with the 3D projection, as well as our architecture software, unless otherwise specified in the request. 8.2 - Ordering Conditions: The contractual information is presented in French and English and is confirmed at the latest when the Client User validates the order. The registration of an order on the site occurs when the Client User accepts the T&Cs by checking the designated box and validates the order. Before confirming acceptance, the Client User has the opportunity to verify the details of the order, the total price, and correct any errors, in accordance with the provisions of the Civil Code. This validation implies full acceptance of these General Terms and Conditions of Sale and Use and constitutes evidence of the service supply contract. After payment of the order, to benefit from the services, the Client User must enter and provide, from their client area, all the data necessary for order processing: photos of the spaces concerned by the order (optional for properties under construction), a plan or sketch, as well as information regarding the expectations and preferences of the Client User determined through a questionnaire. Orders validated by the Client can only be modified upon written acceptance by Pakty Tunisia. Pakty Tunisia's commitment to the orders begins on the day Pakty Tunisia confirms their acceptance by email and after full payment of the due price. No order will be processed if the Client has not accepted the T&Cs and paid the price for the ordered service. Pakty Tunisia's acceptance of the order constitutes the contract between the Client and Pakty Tunisia. By accepting these T&Cs, the Client agrees that the content of the contract with Pakty Tunisia will be delivered on a durable medium. After making the payment, the Client User has a period of six (6) months to complete their online specifications and finalize their Order. After this period, the Client User is informed that their Order will be considered void and will not be refunded. ARTICLE 9 - PAYMENT: You agree to provide current, complete, and accurate information about your purchases and your account for all purchases made on the site. You also agree to promptly update payment information, including email address, payment method, and payment card expiration date, so that we can process your transactions and contact you if necessary. Sales tax will be added to the purchase price if deemed necessary. We may change prices at any time. We use secure payment terminals and accept various online payment solutions in your country's currency. Payment for purchases can be made in two ways: Payment on delivery, in cash only. Online payment by credit card (CIB, Visa, Mastercard, La Poste Tunisienne). For online payment, the customer must enter their credit card number, expiration date, and the three-digit security code on the back of the card directly into the designated area (secure input by SSL encryption) on the website. In case of payment failure, incorrect address, or any other account-related issue, Pakty Tunisia reserves the right to suspend the customer's order until the problem is resolved. We hold the money from your purchase in our account to secure your order; once you confirm receipt of your purchases, the supplier receives the collected money. ARTICLE 10. CUSTOMS FEES: When a package is shipped internationally, it may be subject to import taxes, customs duties, and/or fees imposed by the destination country. These fees are typically due once the package arrives in the destination country. Sellers are required to comply with the laws and regulations of the destination country. Generally, the buyer is responsible for paying customs duties upon receipt of the package. Some countries may require specific documents before sending items. When the required information is not provided, delays in the delivery of the order may occur. Since July 1, 2021, some countries have implemented customs fees that the buyer can pay directly to the courier. Typically, the buyer receives a notification by email from the sender one day before receiving the order. ARTICLE 11. DELIVERY: We offer our customers two options to receive their order: Express Delivery (via Aramex): The purchased items are delivered to the address provided during the order. To optimize delivery, it is advisable to provide a precise address where your order can be received during business hours. Orders are delivered within a maximum of three (3) business days in Tunisian territory. The delivery cost is set at 4,900 DT. If the customer is unreachable, the package is returned to Pakty Tunisia's premises. Pickup: The customer has three (3) days after their purchase on the site to pick up their order; after this period, the order is considered canceled. ARTICLE 12. WITHDRAWAL: The customer has a period of 2 days (48 hours) from the date of receiving the goods to exercise their right of withdrawal on orders placed on pakty.shop. To return the items, please follow the indicated return procedure. In case of a refund request, the customer will be fully refunded the price of the returned item within 7 business days from the date of receiving the items, following a simple request made to our services by email or phone. The refund will be made either by: A credit in the form of a voucher valid for three (3) months, usable on the pakty.shop website (excluding sale periods and promotions), if the customer prefers. A refund by Pakty Tunisia via a bank transfer. ARTICLE 13. EXCHANGES AND RETURNS: Returns and exchanges are not possible for products purchased on sale. No return or exchange will be accepted without the corresponding return slip. The customer has 2 days from the date of receiving the order to proceed with an exchange or return of goods purchased on the site. Beyond this deadline, no returns will be accepted. Return or exchange conditions: The item must be new and as well-packaged as upon receipt. The item must be in perfect condition. Any item deemed worn by the Pakty teams will not be refunded. Returns can be made in two ways: By contacting our services by email or phone, after which we will initiate a return request. The transportation costs for returning the goods are the responsibility of the customer. Exchange conditions: Exchanges can be easily done on Pakty.shop. To report and proceed with an exchange, simply email order@pakty.shop indicating the reasons for the exchange, and then return the product for exchange, always accompanied by the properly filled return slip. Please note that delivery costs are not refunded. ARTICLE 14. PRIVATE INFORMATION: Pakty.shop handles all information regarding its clientele with the strictest confidentiality. During the ordering process, only essential information (name, surname, address, email, phone number, delivery addresses, and billing address) is requested for efficient processing and careful monitoring of the order. These data entered online are stored on a secure server and immediately encrypted. ARTICLE 15. CUSTOMER ACCEPTANCE: By clicking the "Finalize my order" button, the customer declares irrevocably and without reservation their acceptance of the order and the entirety of these general terms and conditions of sale. The data recorded by Pakty.shop constitutes evidence of all operations and financial transactions carried out by the customer. These general terms and conditions of sale may be modified at any time without prior notice. ARTICLE 16. The present General Terms and Conditions of Sale and Use, and all points arising from or relating to them and their application, including their content, are subject to Tunisian law, regardless of the place of performance of substantial or ancillary obligations. The present General Terms and Conditions of Sale and Use are written in French. In the event that they are translated into one or more foreign languages, only the French text shall prevail in case of a dispute.
